JAMS collects personal data through the company websites and directly during in-person or virtual meetings, hearings, and marketing events.
JAMS limits data collection to what is necessary to deliver our Services and to run our Site.
JAMS Services – when you engage with JAMS as a client participating in a JAMS arbitration or mediation or other matter, we may collect the following types of personal data with your active participation and consent:
- Contact Information including your name, position, company name, address, telephone/mobile phone, and work email address.
- Case Preference Information such as for the hearing format, resolution center and Neutral, and other information about your case.
- Case Information including personal data as necessary, relevant, and applicable to the applicable case and required to provide Services.
- Customer Support including your name and contact details such as phone or email address.
- CCTV footage when you enter into a JAMS Resolution Center. Please see the JAMS CCTV policy for more information.
JAMS Marketing – when you engage with our marketing activities as a client or as a prospective client, we may collect the following types of personal data with consent, which can be changed at any time:
- Contact Information such as your name, organization, and work email address, phone, mailing address.
- Membership and Event Registration information, including name, work email address, and location to participate in marketing events.
- Work Email Address to receive information about upcoming events.
JAMS Website Visitors – when you contact JAMS through our websites, we collect the following information you provide us via webforms or account registration:

Does JAMS collect Sensitive Personal Data? JAMS does not collect sensitive data like racial or ethnic origin, political opinions, religious/philosophical beliefs, trade union membership, genetic data, biometric data, health data, data about your sexual life or orientation, precise geolocation, and offences or alleged offences except when we have your specific consent or when we have to in order to comply with the law. JAMS does not use or disclose your Sensitive Personal Data for the purpose of inferring characteristics.
Does JAMS collect children’s data? No. Our Site is not intended for use by children under 13 years of age, and we do not knowingly collect personal data, contact, or solicit information of any kind from children under 13. Information collected as part of our Services is not intended for use in contacting or soliciting information from children.
JAMS does not sell your personal data and does not use automated decision making and profiling.

Data protection law means that we can only use your data for certain reasons and where we have a legal basis to do so. Here are the reasons for which we process your data:

What does each legal basis mean?

Contract: Processing your data is necessary for performing Services or because we have asked you to take specific steps before entering into that contract.

Your data is shared with service providers only when strictly necessary and the transfer is managed by our contracts, policies, and the safeguards and good practices detailed in this Privacy Notice.
As part of your participation in our Services, your case information is only shared as needed to facilitate communication and interaction between you and the parties to proceedings.
Our service providers may only use data we share with them in in accordance with our instructions and under contract - we do not permit our service providers to use any of your personal data for their own purposes.
We do not publish personal data and will only share your personal data with authorized service providers that perform services on our behalf, including marketing, billing and financial payments, data analysis, and technical support.
We may disclose your data in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; in connection with a substantial corporate transaction, such as the possible sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy; or as otherwise required by law.

Any personal data that you provide to us is stored on servers located in secure third-party data centers with restricted access, and which are protected by protocols, procedures and best practices designed to ensure the security of such information.
However, no server, computer or communications network or system, or data transmission over the Internet, can be guaranteed to be 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security.
The personal data we collect is processed at our offices in the United States and in any data processing facilities operated by authorized service providers. By submitting your personal data, you agree to this transfer, storing or processing by us. Where your information is transferred, we will take all steps reasonably necessary to ensure that your data is subject to appropriate safeguards, security, and data protections, and that it is treated securely and in accordance with this Privacy Notice.

11. Data Privacy Framework (DPF)
JAMS complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.
JAMS has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. JAMS has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.
Under the Data Privacy Framework, JAMS is responsible for the processing of personal data we receive and subsequently transfer to a third party acting for or on our behalf, and JAMS is liable for ensuring that the third parties we engage support our DPF commitments.

Candidate Privacy Notice

This Candidate Privacy Notice (“Notice”) describes the types of personal information and sensitive personal information which JAMS (“Company”) may collect during the application and recruitment process, how we may use this information, with whom we may disclose this information, and how to access and update this information.
This Notice applies to the personal information and sensitive personal information about you that you or anyone else may provide (on your or the Company's behalf) to Company during the application and recruitment process (“Candidate Data”) including through our job site and recruitment platforms.
Types of Candidate Data We Collect
The types of Candidate Data that you share with us and/or that we may obtain from third parties, such as your former employers, references, employment screening agencies, recruiters, and recruiting and other websites, include:
- Name, address, email address, telephone number, and other contact information;
- Resume, CV, cover letter, previous work experience, professional licenses and certifications, job skills and qualifications, and education information;
- Online questionnaire results and information from interviews; and
- Any additional information provided or revealed during the application and recruitment process (e.g., language preference).
During the application JAMS collects information, such as nationality, race, disability, veteran status, social security number, birthdate, gender or ethnic origin voluntarily submitted by candidates as permitted or required by local, state, or federal law or regulation.
Use of Candidate Data
JAMS may collect, use, and otherwise process your Candidate Data for human resources and business management purposes, including:
- to evaluate your skills and qualifications for Company positions;
- to communicate with you;
- to maintain appropriate record-keeping related to recruitment and hiring practices and processes;
- to verify your information and conduct reference and background investigation checks, where permitted.
JAMS also may collect, use, and otherwise process your Candidate Data to comply with applicable laws, regulations, legal processes, or governmental requests.
JAMS does not sell your Candidate Data. JAMS also does not share your Candidate Data with a third party for cross-context behavioral advertising.
You are under no obligation to provide Candidate Data to JAMS during the recruitment process. However, if you do not provide the information, we may not be able to process your application properly or at all.
Retention of Candidate Data
If you are hired, your Candidate Data will be transferred to an employee personnel file and used and retained for as long as necessary in connection with your employment for Human Resources and business management purposes in accordance with applicable law.
If you are not hired, JAMS may retain and use your Candidate Data for a further fixed period in order to consider you for other job opportunities or as otherwise required by law. Please note that some information may be retained as necessary to comply with our legal obligations.
Disclosure of Candidate Data
JAMS may disclose your Candidate Data internally and with service providers and other third parties that have been engaged to perform recruitment and employment-related services on behalf of the Company. These third parties are required to use appropriate measures to protect the confidentiality and security of your Candidate Data.
The Company may also be required to disclose certain Candidate Data to third parties as required by law or regulation or in response to legal process or lawful requests by public authorities, including to meet national security or law enforcement requirements.

JAMS is committed to using appropriate technical and organizational measures designed to protect the security and confidentiality of your Candidate Data.

Your Rights
Under certain privacy and data protection laws, you have the following rights:
- Right to Know & Access what Candidate Data JAMS has collected about you, including the categories of Candidate Data, the categories of sources from which the Candidate Data is collected, the business or commercial purpose for collecting Candidate Data, the categories of third parties to whom JAMS discloses Candidate Data, and the specific pieces of Candidate Data JAMS has collected about you.
- Right to Delete your Candidate Data, subject to certain exceptions.
- Right to Correct inaccurate Candidate Data that JAMS maintains about you.
- Right to Restrict JAMS use of your Candidate Data.
- Right to Data Portability of your personal data in a structured, commonly used, and machine-readable format.
- Right to Non-Discrimination against you for exercising any of your rights.
JAMS does not Sell or Share your personal data; does not use automated decision making and profiling; and does not use or disclosure your Sensitive Personal Information for the purpose of inferring characteristics.
Changes to this Notice
We will update this Notice from time to time. We will post the revised Notice with an updated revision date on the Company corporate site and link to it from our jobs site and recruitment platform. If we make any material changes, we will provide notice through these sites or by other means.

JAMS Data Processing Addendum
This Data Processing Addendum (the “Addendum” or “DPA”), reflects the requirements of the California Consumer Privacy Act (“CCPA”), as amended and is incorporated into and forms a part of the master agreement, purchase order, or other terms (the “Agreement”) under which JAMS provides Services to Clients (; collectively the “Parties.”)
Capitalized terms identified in this Addendum shall have the same meaning as defined in the CCPA, unless otherwise noted.
This Addendum applies to the collection, retention, use, and disclosure (“Processing”) of Personal Information to provide Services.
The Parties agree as follows:
- JAMS understands its obligations under the CCPA/CPRA and will comply with them, providing the same level of privacy protections required under the law.
- JAMS will notify Clients if it makes a determination that it can no longer meet its obligations under the CCPA/CPRA.
- For avoidance of doubt, JAMS is a Service Provider as described in the CCPA/CPRA.
Therefore, JAMS shall not:
- Sell the Personal Information Processed on Clients’ behalf.
- Retain, use, or disclose the Personal Information for any purpose other than providing the Services specified in the Terms.
- Retain, use, or disclose the Personal Information outside of the direct business relationship and specifically shall not:
- Combine Personal Information across customers.
- Have, derive, or exercise any rights or benefits regarding Personal Information Processed on Clients’ behalf.
- Engage or outsource Personal Information Processing to any Sub-processors without entering into a written agreement containing appropriate safeguards to the protection of Personal Information with each Sub-processor.
Therefore, JAMS shall:
- Implement and maintain appropriate technical and organizational measures to protect Personal Information against security incidents and preserve the security and confidentiality of Personal Information.
- Ensure access to Personal Information is limited only to employees who directly provide services to Clients, and that those employees are subject to an appropriate means of confidentiality.
- Notify Clients about any possible Personal Information Data Breach without undue delay and take reasonable steps to minimize harm and secure Personal Information.
- Provide reasonable assistance in responding to Consumer Rights Requests.
- Delete or return, as permitted by law, all Personal Information Processed under this DPA upon termination of the Terms.
Notwithstanding anything in the Terms or other document, the Parties acknowledge and agree that JAMS’ provision of access to Personal Information is not part of and is explicitly excluded from the exchange of consideration, or any other thing of value, between the Parties, and is not provided for purposes of cross-context behavioral advertising.
The provisions of this DPA shall apply as long as JAMS Processes Personal Information for Clients.
Your Rights under the Texas Data Privacy and Security Act (TDPSA)
In addition to the specific information about our data collection and processing practices posted in the JAMS Privacy Notice, JAMS Mediation, Arbitration and ADR Services (“JAMS,” “we,” “us” or “our”) wants you to understand your rights and choices under the Texas Data Privacy and Security Act (TDPSA) regarding how we may process your personal information.
Please note that we are required to verify your identity before we are able to process any of the requests described in this Section; and at our discretion, deny your request if we are unable to verify your identity.
We will respond to verified requests within 45-days after receiving the request and will extend by up to an additional 45-days when reasonably necessary, taking into account the complexity of the request.

Your Rights and Choices
The TDPSA provides Texas residents with specific rights regarding their personal information. This section describes your rights under the TDPSA and explains how to exercise those rights. Under specific circumstance, these rights may be limited.
- Right to Be Informed (Know) – You have the right to obtain confirmation whether your personal data is being processed and know the following, which is posted in this Rights Notice and the main JAMS Privacy Notice:
- The categories of personal data to be processed, including, if necessary, any sensitive data.
- The purpose of the processing.
- How consumers can exercise their data subject rights, including the appeal process.
- The categories of data shared with third parties (if any).
- The categories of third parties with whom data is shared (if any).
- A description of the methods through which consumers can submit requests to exercise their consumer rights under the TDPSA.
- Right to Correction – you may request we correct inaccurate personal information and the right to have incomplete personal information completed.
- Right to Delete – you may request we delete any of your personal information, subject to certain exceptions.
- Right to Information Portability – you may request your personal information in a structured, commonly used, and machine-readable format.
- Right to Opt-Out of the Sale of Personal Information – as described in our Privacy Notice, JAMS does not sell personal information
- Right to Opt-Out of Targeted Advertising – JAMS uses cookies on its website and you can learn more and opt-in and opt-out of that data collection and sharing through our Cookie Consent portal <HYPERLINK>.
- Right to Opt-Out /Not be Subject to Automated Processing - JAMS does not use any form of solely automated processing performed on personal data to evaluate, analyze, or predict personal aspects related to an identified or identifiable individual's economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.
Under the TDPSA, you also have the right to appeal any refusal by JAMS to take action on a request and can do so by contacting us through any of the methods listed below.

JAMS CCTV Privacy Notice
Effective June 24, 2024
This Closed Circuit Television “CCTV” Privacy Notice explains the collection and use of personal data by JAMS (“Company”) when visiting Company offices.
At the entrance to all offices is an on-the-spot-notice about the video-surveillance activity that is clearly visible and includes a QR code to access this Notice.
- Why JAMS collects personal data
The Company collects data through the CCTV system to control access and ensure office security for the safety of JAMS staff, visitors, and the property and information located on the premises.
- What kind of data does the Company collect?
The Company collects only images caught on camera, and no voice is recorded.
- Who can access the data?
Access to the CCTV footage is highly restricted, is protected by password and encryption, and can only be accessed with the explicit written authorization of the JAMS Senior Management.
The contracted security company does not have access to recordings taken at JAMS offices.
JAMS does not sell or share any CCTV footage taken at its offices.
- Processing Purpose
The Company uses video-surveillance equipment for security and access control purposes, which is an action necessary for the management and functioning of the Company. JAMS does not use the CCTV footage for any purpose other than security.
- How long does JAMS keep your data?
The Company will keep your personal data for 30 calendar days after your visit. After that period, all CCTV recorded footage is automatically deleted.
