Imhotep Jordan Jr., an innocent man, has been wrongfully imprisoned for 35 years. In 1989, Mr. Jordan was wrongfully arrested and charged with murder. Evidence presented at his trial clearly demonstrated that he was in another city at the time of the crime, with multiple witnesses and video footage supporting his alibi. Despite this, and with no physical evidence linking him to the crime scene, the jury was instructed by the judge to find him guilty of murder. Consequently, he was convicted and sentenced to two consecutive 25-to-life sentences as an aider and abettor, even though he was not present during the commission of the crime. During jury deliberations in 1991, the all-women jury asked the judge multiple times if they had to convict Imhotep of murder if they found him guilty of other charges. The judge initially said no. However, on June 4th, 1991, the judge instructed the jury to find Imhotep guilty of murder, leading to his unjust conviction that same day. This proves the jury was reluctant to convict him of murder until directed by the judge. His life, hopes, and dreams have been stolen by a system that has failed to recognize his innocence. His family and community have also suffered immensely, witnessing a beloved member endure decades of injustice. The broader community is affected as well, as this case exemplifies the severe flaws and corruption within our judicial system that can impact anyone.
In 2019, California enacted SB 1437, which allows for the resentencing of individuals convicted under the felony murder rule who did not actually kill anyone. Mr. Jordan promptly filed a petition under Penal Code Section 1170.95. Although initially denied by Judge Lance P. Jensen on the grounds of unconstitutionality, this decision was overturned on appeal. The appellate court's reversal in June 2020 mandated a resentencing. Despite this clear directive, the district attorney and judges conspired to delay Mr. Jordan's release by waiving time without his knowledge or consent. This continued for four years, during which secret hearings were held, and his case was mishandled. If things remain the same, Imhotep will continue to languish in prison for a crime he did not commit, while the real perpetrators of injustice go unpunished.
