Direct Selling Self-Regulatory Council Recommends Limbic Arc Modify or Discontinue Earnings and Product Performance Claims

McLean, VA – June 26, 2024 – The Direct Selling Self-Regulatory Council (DSSRC) of BBB National Programs recommended that Limbic Arc, LLC, a direct selling company that markets a health-related technology product and nutritional supplements, modify or discontinue product performance and earnings claims made by salesforce members across social media on Facebook, Instagram, and YouTube.

The two earnings claims and nine product performance claims at issue were identified by DSSRC through its ongoing, independent monitoring of advertising claims in the direct selling industry. 

 

Earnings Claims

  • “I’m on my way to financial freedom. You can be on your way too. You can’t just sit back & hope your financial problems will change. Change, of any kind, takes action. Change your quality of life. What are you waiting for??”

Product Performance Claims

  • “Asthma resolved in less than 4 months.”
  • “About 10 years ago I was diagnosed with asthma and its been really concerning because It gets worse every single year and I’ve been using this technology, Limbic Arc, developed Dr. Cook…provides my body with information and this information seems to be working because after three and a half months using the technology my asthma symptoms of the tightness in my chest and the coughing, inflammation, hard to breathe sometimes I don’t have anymore. It’s totally gone.”

DSSRC was concerned that the challenged claims communicated the message that salesforce members can generally expect to earn significant income from the Limbic Arc business opportunity and that Limbic Arc products are efficacious in addressing serious health-related conditions. 

While DSSRC recognized the good faith actions taken by Limbic Arc to remove the posts at issue in this inquiry, it remained concerned that 10 of the 11 posts remain publicly accessible. 

With respect to the posts that are still accessible to the public, DSSRC recommended that the Limbic Arc take additional steps to remove claims, such as using the trademark or copyright violation mechanisms on the social media platforms where the claims are posted. 

Lastly, DSSRC recommends that Limbic Arc provide copies of the correspondence sent to those platforms as a demonstration that it has made a bona fide good faith effort to have the improper claims removed. If Limbic Arc is unable to have the posts removed, DSSRC suggests Limbic Arc consider adding a comment on the posts at issue to inform the public that the claim has not been authorized.

DSSRC will continue to monitor the online and social media advertising for Limbic Arc and its salesforce to ensure that the dissemination of such unsupported claims is not a systemic issue.
