 Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. EXCLUSIVITY, CONSISTENCY, AND TRANS-

PARENCY IN SECURITY CLEARANCE PROCE-
4
DURES AND RIGHT TO APPEAL.

(a) E
 XCLUSIVITY OF
P
ROCEDURES
.—Section 801 of
6
the National Security Act of 1947 (50 U.S.C. 3161) is
7
amended by adding at the end the following:

‘‘(c) E
 XCLUSIVITY 
.—Except as provided in sub-
1
section (b) and subject to sections 801A and 801B, the
2
procedures established pursuant to subsection (a) shall be
3
the exclusive procedures by which decisions about access
4
to classified information are governed.’’.

(b) T
RANSPARENCY 
.—Such section is further amend-
6
ed by adding at the end the following:
7
‘‘(d) P
UBLICATION
.—

‘‘(1) I
N GENERAL
.—Not later than 180 days
9
after the date of the enactment of this subsection,
10
the President shall publish in the Federal Register
11
the procedures established pursuant to subsection
12
(a).

‘‘(2) U
PDATES
.—Whenever the President
14
makes a revision to a procedure established pursuant
15
to subsection (a), the President shall publish such
16
revision in the Federal Register not later than 30
17
days before the date on which the revision becomes
18
effective.’’.

N GENERAL
.—Title VIII of the National
21
Security Act of 1947 (50 U.S.C. 3161 et seq.) is
22
amended by inserting after section 801 the fol-
23
lowing:

‘‘(a) D
EFINITIONS
.—In this section:

‘‘(1) A 
GENCY 
.—The term ‘agency’ has the
4
meaning given the term ‘Executive agency’ in section
5
105 of title 5, United States Code.

‘‘(2) C
LASSIFIED INFORMATION
.—The term
7
‘classified information’ includes sensitive compart-
8
mented information, restricted data, restricted han-
9
dling information, and other compartmented infor-
10
mation.

‘‘(3) E
LIGIBILITY FOR ACCESS TO CLASSIFIED

INFORMATION
.—The term ‘eligibility for access to
13
classified information’ has the meaning given such
14
term in the procedures established pursuant to sec-
15
tion 801(a).

‘‘(b) I
N
G
ENERAL
.—Each head of an agency that
17
makes a determination for eligibility for access to classi-
18
fied information shall ensure that in making the deter-
19
mination, the head of the agency or any person acting on
20
 behalf of the agency—
21
‘‘(1) does not violate any right or protection en-
22
shrined in the Constitution of the United States, in-
23
cluding rights articulated in the First, Fifth, and
24
Fourteenth Amendments;
