ICYMI: IRBA CEO, Imre Nagy addresses the question of Watchdog or Bloodhound at SAICA Leaderex. Based on the social compact the role of auditors is to build trust in financial statements. Auditors should consider the risk inherent in the value chain of financial reporting at the audit entity, where the risk of fraud is high, the deeper the auditor should dive. Don't necessarily become a bloodhound, but use the power of the audit to do a bit more to uncover what is glaringly there. [WATCH]

This week has provided a real variety of challenges as well as some very enjoyable catch ups. One of those I thought I would highlight. Co-Trustees - Where are you going? In recent days, we have been increasingly asked by individual co-trustees whether their activities for the trust, which are carried out in close coordination with a professional corporate trustee, also fall under the FinIA Act and would therefore also require a FINMA licence. Unfortunately for many, this question can only be answered with a clear YES.   This is regrettable insofar as many individual co-trustees have taken on this activity for non-commercial reasons (quite often as a favor to the settler and his/her family). In addition, many individual co-trustees do not have up-to-date trust knowledge and therefore have to rely entirely on the corporate trustee. However, as the FinIA law makes no distinction between trustee and co-trustee, such responsibility can probably no longer be justified for all individual co-trustees, whereby the last FINMA decision of 2 February only highlighted this predicament once again.   We at Carey AG, would be delighted to actively support co-trustees in coping with these challenges and to develop the best possible options for them and their clients. Dear readers,   Today we would like to talk to you about the advantages of making use of Nordic GEM’s fiduciary services, with a particular attention to our directorship offer.   Let us begin by pointing out the obvious: fiduciary services are expensive, and they do involve some risks, both for a client, but also personally for the individual providing said services.   The question arises, then, if these are the risks, then what are the benefits?   ✅ First of all, sometimes businesses do not have a choice, as they need to comply with legal requirements, and they might be too small or too young to be able to source someone from inside their organization for a fiduciary role.   ✅ Secondly, having someone local on the Board (or adjacent role) allows a business to take a lot of shortcuts when having to deal with local authorities and their bureaucratic web. Ever wondered about the term "trust settlor"? In the realm of trusts, the settlor, also known as the grantor or trustor, plays a pivotal role. Simply put, the settlor is the individual who establishes the trust. They're the one who decides to transfer assets into the trust for the benefit of beneficiaries. But it's more than just setting things up. The settlor defines the terms of the trust, including its purpose, beneficiaries, and how assets are to be managed and distributed. Think of them as the architect, crafting the blueprint for the trust's operation. Once the trust is established, the settlor may continue to have involvement, especially if they retain certain powers over the trust or its assets.
