California Bar Exam - Board of Trustees (edited snippet) - 16 May 2024 Meeting. I made an error on the date that first pops up on the screen, I put 2021... it was indeed 16 May 2024! Oops. Note, what is being discussed, was the tabled vote on the Kaplan North America creation of Multiple Choice Questions for the Feb 2025 California Bar Exam. The Board of Trustees Meeting from 16 May 2024 is now available online, but the two most important parts of that meeting to me had been my Public Comments, and the last sentence of the meeting. The Board of Trustees is told to be on the lookout for a "poll" for a Special Set meeting (the poll is a tool for them to agree on a time to meet). Here is an edited version of the meeting with my comment, and that last bit of the meeting.:

REVIEW OF EPO BOARD OF APPEALS 2023 CASELAW / powered by ADIPA Morten Bruus, Armin Sarvan and I are sat listening to a review of the EPO BoA caselaw that moved goalposts in 2023. Interestingly, the first segment is about claim interpretation. Not all Boards will agree with the very recent decision from the Court of Appeal of the UPC in terms of when the description and drawings should be taken into account. Professional Witness. Third Party Costs Order. Successful Appeal. Duty of Expert Reaffirmed. Mr Mercier was qualified to give an opinion in relation to the viability of a tooth and whether its condition was such that it required extraction. Both he and Mr Webster gave their opinions on the point given that it went directly to causation. For these reasons the judge was wrong, in my view, to conclude that Mr Mercier had stepped outside the boundary of his expertise in giving his opinion about breach of duty and causation in relation to the examination carried out prior to extraction or the viability of the tooth which Miss Robinson expected to be removed but which was not. There may well have been grounds to criticise Mr Mercier's performance as an expert witness and to attack his conclusions, but this was not an exceptional case and did not involve a flagrant or reckless disregard of an expert's duty to the court. On the facts of this case it would not be just to make a costs order against him in any amount.
