A group of senators has reached a deal to ban stock trading by members of Congress. Voters believe lawmakers should ban stock trading for politicians with privileged information, but such bills have failed over the last few years. But with the Senate’s support, the bill could actually get somewhere. Here’s what this bill looks like: - The deal would immediately prohibit Congress members from buying and selling stocks 90 days after the bill is signed. - Would also ban member spouses and dependent children from trading stocks starting in March 2027. - Penalties for violating the law would be either the monthly salary of a lawmaker or 10% of the value of each asset they buy or sell. There is still a long way to go before this can be implemented, but I think most Americans believe it’s a pretty fair idea. While the new Speaker of the House, Mike Johnson, does not personally own individual stocks, he has yet to weigh in publicly on the push in Congress to ban members of Congress from buying and selling stock. 70% of voters support banning members of Congress from trading individual stocks. According to a New York Times report, between 2019 and 2021, 81 Democrats and 101 Republicans filed up to 3,700 trades with up to $100 million in possible volume. Many had 100% winners and were perfectly timed. So, it’s no surprise that Congress beat the market in average returns in 2021. Because members of Congress often invest in the very companies they oversee in Congress, they often have more knowledge and awareness — and even insider information — of the business before placing their winning stock bets. Now, Congress has introduced the bipartisan Ending Trading and Holdings in Congressional Stocks (ETHICS) Act, which bans members of Congress from trading stock, and bans their spouses and dependent minors from owning or trading securities, commodities, or futures.
