On July 1, 2024, newly enacted privacy laws in Texas and Oregon will come into effect. The new consumer data protection measures, along with authorized agent provisions, will enhance the control residents have over their personal data, aligning with the trend of increasing state-level privacy legislation across the U.S. Texas and Oregon have become the tenth and eleventh states, respectively, to enact general privacy legislation, following California, Virginia, Colorado, Connecticut, Utah, Iowa, Indiana, Tennessee, and Montana. Like the groundbreaking privacy laws in California and those of other states, the Texas and Oregon laws will improve consumer privacy and security nationwide as more businesses move to comply with these regulations. Does it ever cross your mind how the law makers plan on staying above the curve of cyber-crime? This article summarizes six new cyber privacy laws that may be worth checking out. A few take aways are as follows: 1. The Virginia Consumer Data Protection Act (VCDPA) was signed into law in 2021 and is scheduled to go into effect in 2023. 2. While each intentional violation of the California Consumer Privacy Act (CCPA) may be penalized by up to $7,500, the California Privacy Rights Act (CPRA) provides those violations involving the PII of minors, intentional or unintentional, may also result in fines up to $7,500. 3. On March 25, 2022, Utah became the sixth state to enact a comprehensive privacy law, the Utah Consumer Privacy Act. Texas AG Launches Data Privacy Team. In addition to the Data Privacy and Security Act, the newly created team will enforce other privacy-related laws, including #COPPA and #HIPAA. Companies handling consumer data must carefully navigate a gauntlet of varying state privacy laws, in addition to industry-specific federal regulations. This increased regulatory scrutiny by the Texas AG highlights the urgency to ensure compliance with state privacy laws. New: I honed in on one important component of the American Privacy Rights Act discussion draft bill: the way it handles the largest, most-prolific purveyors of Americans' personal data. In its current form, the legislation would bring some much needed sunlight to an otherwise shady industry, forcing data brokers to identify themselves and their business model prominently on their websites, offer clear opt-out options for data collection and create a national registry to help policymakers and the public better track the industry. But critics said the measures lack the kind of harder regulatory bite that would meaningfully constrain the widespread sharing and selling of American data. https://lnkd.in/ed5PVapk

As I dig deeper into my degree I start learning and discovering so many things I never thought I would look at. Part of this was the law pasted below. I did not know Colorado had privacy laws like this. The most fascinating thing I find is the definition of consent. (5) "CONSENT" MEANS A CLEAR, AFFIRMATIVE ACT SIGNIFYING A CONSUMER'S FREELY GIVEN, SPECIFIC, INFORMED, AND UNAMBIGUOUS AGREEMENT, SUCH AS BY A WRITTEN STATEMENT, INCLUDING BY ELECTRONIC MEANS, OR OTHER CLEAR, AFFIRMATIVE ACTION BY WHICH THE CONSUMER SIGNIFIES AGREEMENT TO THE PROCESSING OF PERSONAL DATA.
