The Biden administration's recent executive order on artificial intelligence includes a provision for a comprehensive review of federal data collection practices, particularly regarding commercially available information (CAI) that contains personally identifiable information, marking the first government-wide accounting of such practices. 2. The order demands increased scrutiny of data brokers and aims to establish guidelines on agencies' collection and usage of commercial data to reduce privacy risks, potentially revealing how agencies like law enforcement, immigration, and even health agencies gather data, and how such data may have been abused. 3. The executive order also ties in with how artificial intelligence collects and uses personal data. Misuse of such data by AI systems, which could result in false and damaging inferences, is considered a substantial risk. From a business perspective, the fact that the UK has chosen to have a different set of criteria for US data transfers than the UK will lead to greater rather than lesser costs for business. Business will now need to determine whether data it has obtained about #EU residents under the UK-EU adequacy decision (itself somewhat flawed in my and other commentators’ opinion) can be transferred to the US. I cannot see why commercially the UK could not have adopted the same rules as in the EU-US transfer framework as that would have minimised the extra work for business. It seems that yet again, the political desire to do something different to show that the UK is not in the EU has countered the obvious logic in standard rules. At the present time #Scotland does not have its own rules. The Scottish Information Commissioner only deals with Freedom of Information.
