Now #conveyancers when dealing with developers on #newbuilds not only have to worry about defective workmanship, breaches of planning control, one-sided legal documents and building on floodplains. They now have to consider the emerging terror of 'Concretebergs'. This problem is not limited to major infrastructure works. There have been many reports from snagging professionals of concrete being poured or dumped down the drains of new houses. Conveyancers should always insist on 'snagging clauses' augmented by a retention. Sadly developers can't be trusted. How will 'Material Information' (MI) help in this scenario? MI will make matters worse since it will encourage aggressive developers to insist that their one-sided contracts sans snagging provisions are accepted.

Driving through DC on a very rainy Saturday made me think of the recent news that the Northeast Boundary Tunnel is now open. For those not familiar with the DC Clean Water’s Clean Rivers Project, this is one of many tunnels that Washington DC will have to mitigate combined sewer overflow from their sewer system by adding millions of gallons of buffer capacity. Completely out of sight to surface dwellers, this 27,000 foot long tunnel lies over 50 feet below ground. This project will almost completely eliminate combined sewer overflows to the Anacostia and greatly reduce flooding. The Anacostia River has already been restored to a point where swimming is safe 80% of the time, the completion of this project should only make that better. While this is a positive story this should be a lesson to everyone that large physical infrastructure cannot be easily changed. Water pipes are not a software program where you can push a low-cost patch during operation. Once you choose to build, or not build, infrastructure during initial construction it’s going to cost a lot more to add it down the road. https://lnkd.in/gnVhcf2m
