NCLA amicus brief asks #SCOTUS to end SEC gags on targets of settled enforcement cases.👏 We've filed the brief in Elon Musk v. SEC urging the Court to grant cert petition and strike down SEC’s “Gag Rule” censoring Americans with whom it settles a regulatory enforcement case. The SEC has no power to regulate the future speech of those with whom it settles and this Gag Rule is a direct infringement on First Amendment rights not just for Elon Musk, but all Americans who settle enforcement cases with the SEC. The Gag Rule far exceeds the SEC’s powers as no agency has any inherent power to make law.
