We have an article out in Law360 on AI-generated voice calls and #FCC regulation. These calls have actually not been banned by the FCC but are highly regulated, including under the #TCPA. And as this article went to press, the #FTC jumped in too to announce that AI-based impersonation can be unlawful under a new rule. Regulation is certainly moving fast in this area, and there's more on the state front as well. #AI #privacy #fintech #aigovernance with Kathleen Scott Kevin Rupy https://lnkd.in/eyE55eXA

The California Consumer Privacy Protection Agency recently released draft regulations on automated decision-making technologies (ADT) under the California Consumer Privacy Act (CCPA). Link in comments. These regulations aim to govern the use of AI in processing personal information and profiling and require businesses to provide consumers with pre-use notices, options to opt out of certain ADT uses, and access to information about how their information is used by the business. However, concerns over the broad ADT definition and exceptions to opt-out rights have prompted the agency to send the draft back for further revision, highlighting an effort to ensure balanced consumer protection and business interests. Businesses in California should closely monitor these developments and be prepared to seek legal guidance to ensure compliance with the evolving regulatory landscape. Why should we care about Privacy? A Privacy program requires that organisations invest time and money in an effort that doesn't necessarily provide a direct financial return on that investment. Why should an organisation care about Privacy?. - Privacy is an ethical obligation - Laws and regulations require privacy protection like GDPR, DPDP act - Poor Privacy practices reflect poorly on an Organisation - Consumers demand strong privacy practice - Emerging technology like AI creates a new privacy concern To comply with Privacy Requirements Email to info@kavachone.com

As modern data, legal matters, investigations, and data privacy challenges expand in scale and complexity, solutions must evolve accordingly. Despite the buzz surrounding the latest promises or capabilities of generative AI in eDiscovery, legal teams often require solutions that can efficiently scale to their current needs. Implementing platforms or technology designed solely for larger or more specific matters can be burdensome and resource-draining, leaving teams ill-prepared for the diversity of projects they face. This week, the Daniel Law Technology and Data Protection Team has prepared a daily post summarizing the most important takeaways from five hot topics in its area. The first post addresses the challenge of dealing with the possibility of AI discrimination. Why does this problem exist? What do existing and upcoming Brazilian legislations say about it? Additionally, it presents ways to address it internally and mitigate the risk. Our goal is to enable our clients to confront this issue with a solid risk approach, alleviating fears. We believe that this enables the best business decisions in an uncertain scenario. #DataProtection #IA #IADiscrimination
