Mayer Brown’s Nicole Saharsky and Gail Levine filed an amicus brief on behalf of the Securities Industry and Financial Markets Association, the Futures Industry Association, the Managed Funds Association, and the American Investment Council, challenging the FTC’s rule banning non-compete agreements nationwide. The Northern District of Texas just agreed with our clients. It preliminarily enjoined the FTC from enforcing its rule on the parties. Last week, the Fifth Circuit Court of Appeals overturned the SEC’s New Private Fund Rules introduced in August 2023 (the “Private Fund Rules”). Given that the Private Fund Rules imposed several limitations and prohibitions that ran counter to the fundamental principles of a private fund, this was a significant victory for private fund advisers.
