On April 7, 2024, US Senate Commerce Committee and House Energy and Commerce Committee unveiled the American Privacy Rights Act of 2024 (APRA), a comprehensive privacy bill that, if enacted, would set significant data privacy and security standards. The APRA would largely preempt similar comprehensive privacy laws enacted by individual states in the last few years. The APRA would also provide individuals with a limited private right of action to seek monetary and other relief for certain violations by covered entities. Although the APRA is not likely to pass in the current Congress, the bipartisan effort suggests future comprehensive federal legislation. #dataprivacy

Great summary and insight by my colleagues on Vermont's proposed privacy act, which did not become law. Private rights of action are an issue to track considering the private right of action in the current draft APRA in Congress. It will be interesting to see if the Vermont law's failure is a blip or a harbinger as Congress and several states continue to draft comprehensive privacy laws.

Congress has proposed a new federal privacy bill, the American Privacy Rights Act (APRA), which could have significant consequences for businesses across various industries. If enacted, this bill could preempt the 16+ state privacy laws that have been enacted in recent years, placing certain obligations on businesses regarding consumer information. The APRA would also impose security standards to protect personal information in the possession of businesses. ICYMI there's a new federal privacy bill on the table. I wrote about the American Privacy Rights Act and its road ahead: it faces a steep uphill battle (as any federal privacy law will...), but the context is very different today than 2 years ago when the last comprehensive privacy bill (the ADPPA) was introduced.
