#PixelTracking is a double-edged sword in the digital age. While it helps companies tailor ads and improve user experience, it's also leading to a surge in lawsuits due to the unauthorized collection of personal information. Shockingly, tracking pixels are found on 30% of the top 80k websites, even on health portals. Mass General Brigham recently paid $18m to settle a lawsuit over such issues. Over the past year we have learned that many companies providing contact management or similar SAAS to healthcare providers have 3rd-party ad trackers like Facebook Pixel or Google Analytics embedded in their software. This means that patients who use this software to set up appointments with their healthcare providers or respond to appointment confirmation requests are having their personal health information shared with 3rd party companies Facebook and/or Google. This unauthorized disclosure of PHI has got to stop. Today, I am calling out Weave Communications and their CEO, Brett White [getweave.com]. The Markup's Blacklight Search tool found that Weave's contact management app has 12 ad trackers embedded in their software. If you are a HIPAA Covered entity using the Weave patient contact system for appointment management you need to be aware of recent guidance issued by OCR & FTC regarding the use of online tracking technologies. Many organizations have concluded that use of ad trackers by their business associates is a breach of PHI under HIPAA and/or state law. https://lnkd.in/enwjtuse.
