Allowing the Special Examiner to release the audio of Discovery would decrease incivility, as it would allow victims to review it with senior counsel to determine if it amounts to professional misconduct. Written transcripts do not capture bullying or intimidation caused by raised voices, tones, interruptions etc. Allowing videotaping at ED would quash most incivility.

The introduction of the collective action regime in 2015 represented an amazing turning point in my career. I'd been a competition lawyer for several years by then primarily working for and advising businesses. However, it was rare for me to genuinely enjoy what I did; I got a buzz from dawn raids and the general combat of proving a point or an argument in my clients' favour but it always felt like an uphill struggle (with some notable exceptions) to put competition law (and compliance with it) front and centre of a businesses purpose. It was sidelined at best or deliberately ignored at worst, often with a risk/benefit analysis to rationalise a board's decision to continue a problematic practice. The claim with Justin Le Patourel against BT changed that and I saw how it could more quickly move the dial than I'd been able to do previously - or probably ever could otherwise. There now exists a real community of individuals who love what they do and are passionate (hello The Collective Redress Lawyers Association (CORLA)) about consumer redress and using the collective actions' regime to the fullest extent possible - and yes that means being creative! In less than 4 years Milberg London LLP is now a leading player in this space and its a testament to all the amazing people who work here. Whether I'm "Up and Coming" thank you Chambers and Partners or a "Leading Individual" thank you The Legal 500 (Legalease) it's a privilege to be ranked (alongside colleagues Edward Cardington, Polly Blenkin and James Oldnall) in such a dynamic and important area as #grouplitigation.
