What’s new with California’s #prop65? In November, we saw a surprising number of claims alleging metals in dietary #supplements 💊, along with the usual claims alleging metals in a number of #foods 🍜, and phthalates in a wide variety of #consumerproducts 👛. The key allegation here is that the presence of chemicals on the #prop65list in these products means that the products must have a #proposition65 warning label. Judge Rejects Suits Claiming PFAS In O.B., Playtex Tampons Law360 (January 16, 2024, 5:48 PM EST) -- Two putative class actions alleging that certain types of tampons have harmful "forever chemicals" are deficient because they lack sufficient backing for the claim, a California federal judge has ruled. U.S. District Judge Araceli Martínez-Olguín of the Northern District of California granted Edgewell Personal Care Co.'s motions to dismiss the cases concerning O.B. Organic and Playtex Gentle Glide product lines on Friday. In doing so, the judge ruled that allegations concerning testing are "cursory," with no specificity as to the results reached or "any other findings that would support the plaintiffs' interpretation of those results." "As such, these allegations are devoid of the factual content necessary to nudge plaintiffs' claims, based on the theory that Edgewell's tampons contain [per and polyfluoroalkyl chemicals], from possible to plausible," the order says. "Similarly, allegations referencing patent applications or product labels that mention certain tampon components or ingredients are likewise deficient, as plaintiffs merely speculate that the hydrophobic components mentioned therein must or are likely to contain forever chemicals because those chemicals are 'frequently' used to make materials water-repellent," according to the judge. https://lnkd.in/eArhdMf6 Hawkins Parnell & Young, LLP
