Why don't regulators look in the rearview mirror more? We regulators are really good at creating regulations - it's kind of our thing. But how do we know that we've done a good job? How do we know that we are effectively addressing a problem? Typically, we rely on feedback. If we hear a lot of voices telling us that we've screwed up, we'll revisit what we've done. But shouldn't we be more proactive than that? Can't we do better? There's a whole field of study called 'retrospective review' that does just that. It asks, "Did we achieve our desired outcomes?" and attempts to arrive at an informed answer. This work takes dedicated resources that could be deployed to address new problems rather than revisiting old ones. This makes it hard to make the case for retrospective review. However, in my opinion, this should be a core function of a well-run regulatory body. Constantly moving forward with new regulations is something of a leap of faith. Knowing what has worked and what has not would add an element of certainty that doesn't generally exist as we rush forward with regulatory initiatives. A couple of small changes would go a long way to facilitating retrospective review: 1) Clearly articulate the desired outcomes from a regulatory intervention. What are we hoping to achieve? With this clarity in hand, we can more easily return to intervention to see if it worked, and 2) Put sunset clauses in regulations. A sunset clause cancels a piece of regulation on a certain date if it is not reviewed and updated. This puts pressure on the regulator to revisit their regulations to ensure the regulatory framework is modern and innovative. 📞 The DMA calling. Gatekeeper response: much ado about nothing. My take: what to expect from the DMA's compliance reports, it's hard to tell. Last Thursday, the gatekeepers started publishing their compliance (and consumer profiling) reports. Find them at the following link: https://lnkd.in/dHBEBCPV Now, it all boils down to how the Commission decides to perform its overview of the compliance of the provisions. However, it is still too early to tell whether the DMA will deliver on its wish to narrow down information asymmetries as a consequence of the reversal of the burden of intervention against the gatekeepers. For the moment being, if one analyses the substantive content of the compliance reports, the incentives that influence the gatekeepers to narrow down the gap are still quite low. Perhaps, the European Commission's reaction in the coming months in scrutinising whether they meet the benchmark of 'effective compliance' will determine whether the DMA may operate with greater leverage in this respect. Stemming from this same idea, I have engaged in providing my first in-depth comment on this first round of compliance reports. The post presents a two-fold analysis based on the fact that: - The DMA's regulatory templates issued by the EC this last year have been, for the most part, forgotten by the gatekeepers. The form of the compliance reports is that of differentiating between applicable and non-applicable provisions, rather than exhaustively listing compliance of the items required by the templates. - The technical solutions that the gatekeepers have presented in response to Articles 5(2), 6(9) and 6(10) may fall short of compliance, although the locus of the EC's analysis (and the benchmarking of contestability and fairness) is a moving target. At times, gatekeepers interpret provisions to their own benefit, whereas in other instances they simply address technical implementation in the abstract.
