New Post: Executive Turntable: DiMA Gets Rushing; Luminate Focuses on Indie Retail; Palm Tree Guys Hire COO - https://lnkd.in/gcRvJ8MB - It’s time for another spindle around the Executive Turntable, Billboard’s comprehensive(ish) compendium of promotions, hirings, exits and firings — and all things in between — across music. Earlier this week, UMG announced a “strategic organizational redesign” that has so far resulted in several top executives — and many others — losing their jobs across the label group, though the scope of the headcount reduction is still unclear. Billboard’s Dan Rys is following closely here. The Digital Media Association (DiMA) hired seasoned legal exec Colin Rushing to the newly crafted position of executive vp and general counsel at the music streaming trade group. Rushing previously spent nearly 14 years at SoundExchange, where he rose from senior counsel to chief legal officer during a consequential tenure —  his job was to lead rate-setting efforts before the Copyright Royalty Board — that made him a fixture on Billboard‘s annual list of top music lawyers. Since leaving SX in September 2021, he has taught at Belmont University and acted as director of the Copyright Society of the South. “ brings all his invaluable expertise of US copyright law and a reputation for achieving consensus solutions,” said DiMA President and CEO Graham Davies. “Colin’s knowledge of the US licensing system combined with his passion for championing streaming will be hugely valuable. Rich initially joined Red Street as a consultant in 2022 and was named COO later that year. Rich previously served as country lead at Amazon Music. Rich’s career also includes time as Big Machine Label Group’s senior vp of sales, marketing and interactive, as well as time stints at UMG Nashville, DreamWorks, Arista Nashville, BMG and more. Elsewhere at Red Street, Sally Allgeier has been promoted to national director of country promotion, while Jess Loper has joined as vp of A&R and publishing for Red Street Christian. Loper previously served as vp of brand management for Toby Mac’s Gotee Records and Publishing. Amanda Roach also joins Red Street Records as manager of country A&R and Publishing. - Yer a wizard, Harry! ⚡️🧙♀️ ️But his magic wand wasn’t enough this time to convince the Borgarting Appeal Court of #trademark infringement in Norway allegedly made by concert promoter Star Entertainment 🪄®️ ❓Star had set up several unauthorised concerts (and were planning for more) with music from the Harry Potter movies. Warner Bros (producer of the movies) was not spellbound by the idea and sued Star for copyright and trademark infringement. ⚖️ Although the Appeal Court sided with Warner in the #copyright dispute (see more below), Star was acquitted of Warner’s trademark infringement claims due to their descriptive use of the Harry Potter name in the promotion of the concerts. ⚖️ The Appeal Court also concluded that Harry Potter could not be considered well known (and thus enjoying special protection) as most consumers would not view the use of the name as a guarantee that a concert or event was arranged by one commercial origin. 👉 Together with Noah Fossum (Legal Trainee) I have written a report on the trademark aspects of the Appeal Court’s interesting decision for World Trademark Review. ©️For the copyright aspects of the case, I may recommend Morten Smedal Nadheim bewitching report for Immaterialrettstrollet available here (in Norwegian only): https://lnkd.in/denZ7q_M 👩⚖️ The copyright claim of the decision is appealed, meaning that the Appeal Court's decision regarding the trademark aspects is final. New Post: Sony Music Warns Artificial Intelligence Companies: Don’t Harvest Our Data - https://lnkd.in/dGjJSEGz - Sony Music warned tech companies not to mine its recordings, compositions, lyrics and more “for any purposes, including in relation to training, developing, or commercializing any system,” in a declaration published on the company’s website on Thursday (May 16).  In addition, according to a letter obtained by Billboard, Sony Music is in the process of reaching out to hundreds of companies developing generative AI tech, as well as streaming services, to drive home this message directly. Related Sony Music Says Platforms Are Using Loopholes to ‘Drag Their Feet’ on Nearly 10,000 Deepfake… 11/29/2023 The pointed letter notes that “unauthorized use of SMG Content in the training, development or commercialization of AI systems deprives SMG Companies and SMG Talent of control over and appropriate compensation for the uses of SMG Content, conflicts with the normal exploitation of those works, unreasonably prejudices our legitimate interests, and infringes our intellectual property and other rights.” GenAI models require “training” — “a computational process of deconstructing existing works for the purpose of modeling mathematically how work,” as Google explained last year in comments to the U.S. Copyright Office in October. “By taking existing works apart, the algorithm develops a capacity to infer how new ones should be put together.” Through inference, these models eventually can generate credible-sounding hip-hop beats, for example. Whether a company needs permission before undertaking the training process on copyrighted works is already the subject of a fierce debate, leading to lawsuits in several industries. Interesting article about SiriusXM facing a class action lawsuit due to the company including "royalty fees" in their customers' bills. The lawsuit indicates that the fees had been falsely labeled to imply that it's mandated by the government to pay for music rights.
