Please donate to the Internet Archive, in their pursuit to make digital access of books available to the world. It is a blow to my work as a Reference Librarian. I often give users a digital lending option via Internet Archive. IA is appealing because users being able to digitally borrow falls uner Fair Use In American copyright law. I fail to see how it’s having an impact on big publishers bottom line. If anything it’s using older books no longer used or sold by them. It’s creating opportunities for publishers if anything, by encouraging a readership. Big publishers are losing the PR game through removing all of the books from IA.

Following this closely. Controlled digital lending has been a hot issue in the Canadian copyright community for at least a decade and in 2020 many organizations had to scramble to continue to provide access to research collections under new and exceptional global circumstances imposed by the COVID-19 pandemic. Since controlled digital lending doesn’t merely involve lending, but copying as well, this makes CDL model a more complex legal issue. From accessibility perspective, copying is permitted unless more readily available alternatives are "commercially" available (which is never the case so we scan materials and make them accessible). CDL challenges author rights and commercial publisher models highlighting increasing tensions between what our organizations want/need to serve our users better and the landscape of commercial publishing.

The stampede over our digital civil rights continues in the year of our Lord 2023. See attached. A couple of tips to protect your humanity: 1. Share some, but not all, your opinion online. 2. Request and obtain a copy of your written, spoken or video recordings. If these companies are going to make BILLIONS from aspects of your content, you can at least make THOUSANDS through speaking engagements, private coaching and/or teaching others your skills. 3. Have more off-the-record discussions. You know not EVERYTHING needs to be recorded or pushed into some digital format. It’s becoming more valuable to be present and enjoy the conversation. As both the Court of Appeal and Pat Treacy referred to The Welsh Ministers v Price and another[2017] EWCA Civ 1768, [2018] in Price and another v Flitcraft Ltd and others [2024] EWCA Civ 136 and Wise Payments Ltd v With Wise Ltd and others [2024] EWHC 234 (IPEC), I thought it would be useful to discuss that case. Although it focused on the joinder of parties to proceedings to restore a struck-off company to the Register of Companies it also related to copyright in a photo of Dylan Thomas and his bride which led to Pablo Star Media Ltd v Bowen [2017] EWHC 2541 (IPEC). Essentially CPR 19.2 is to be given a wide interpretation. The court has the power to join a party to proceedings even after it has given judgment, Two conditions have to be satisfied. The first is that the new party can assist the court to resolve all the matters in dispute in the proceedings. The second is that it should be desirable to add the new party to achieve that end. https://lnkd.in/eFSXE5R7
