"The India Digital Personal Data Protection Act is a reality now. Every organization - big and small - has to comply with its basic tenets. The big challenge ahead is: 'Do organizations and everyone else in the vast ecosystem really understand what this Act is about, what are its implications at the ground level, and what exactly needs to be done about it?" This fundamental understanding needs to spread far and wide beyond our legal and tech experts. It needs to seep into every organization across all levels. An average citizen needs to understand the powerful rights and privileges that have come her way as a result of this law - as well as her obligations. The International Academy of Digital Governance (#IADG) has been set up to focus on addressing this challenge. A joint initiative of Global Talent Track and Arrka, IADG leverages the vast training expertise of GTT and its Digital Learning Platform #SkillsAlpha combined with the deep Data Privacy domain expertise of Arrka to bring out effective Training and Awareness programs in this domain. IADG is launching its operations via its first course: DPDPA 101. DPDPA 101 is a level 1 course that covers the key tenets of the DPDPA, its underlying principles and rights, and various obligations. Mission DPDPA: Let us make it happen In anticipation of the impending notification of the DPDPA rules within the 100 day agenda of Modi 3.0, Naavi invites like minded individuals and institutions to join hands in "Mission DPDPA" with a motto; Let us make it happen. As we say, one can take the horse to water but cannot make it drink. Similarly we can make the law on privacy but we cannot force public to make use of it nor organizations to work for compliance. Spread the knowledge of what are the Rights and Duties of Citizens under DPDPA 2023 amongst the general public including students and faculty of Law, Engineering, Management. 2. Spread the knowledge of what are the compliance requirements under DPDPA 2023 by organizations including the Directors, CxOs and others. 3. Provide tools of empowerment of individuals through Certification Programs 4. Provide tools of empowerment to organizations through a framework for compliance along with a system of third party audit, assessment and conformity assurance certificates. 5. Provide Jurisprudential suggestions to the Government through Policy Advisories placed in the public domain. 6. Encourage different industry sectors to develop self regulatory guidelines and work towards acceptable sectoral guidelines. 7. Encourage tech developers to adopt “Compliance by Design” and incorporate DPDPA 2023 compliance when products and services are designed including tools to assist others to be compliant such as AI tools and Governance support software systems. Recently, I had the privilege of being a #speaker at the IAPP - International Association of Privacy Professionals Hyderabad Chapter #KnowledgeNet event titled "#shield." Joining me were Chetandeep S. Batra CIPP/E, a #legal #expert , and Srikar Ponnapalli, representing the #technological front.   During my #presentation , I delved into the realm of #informationsecurity , focusing on safeguarding organizational #data , particularly from the perspective of a #legalprofessional navigating the complexities of #technology . Central to my discourse was the imperative of 'knowing your data' through comprehensive #datadiscovery . After all, without a clear understanding of one's data landscape, effective #protection #measures are futile. Conduct a Data Audit: Identify what personal data you collect (student information, staff records, etc.). Understand the purpose for collecting each data point. Determine how long you store the data. 2. Develop Data Governance Policies: Create clear policies outlining data collection, usage, retention, and sharing procedures. Ensure these policies align with DPDP Act principles like informed consent and data minimization. 3. Obtain Informed Consent: Implement transparent mechanisms to acquire consent before collecting and processing personal data. Clearly explain the purpose of data collection, how it will be used, and with whom it might be shared. 4. Implement Data Security Measures: Protect personal data from unauthorized access, modification, or deletion through measures like: Encryption Access controls Regular backups 5. Train Staff on Data Protection: Educate staff on their responsibilities regarding data handling and data security. Train them on recognizing and reporting potential data breaches. 6. Appoint a Data Protection Officer (DPO) (if applicable): Larger institutions may need to appoint a DPO to oversee data governance and compliance.
