The Government of India in its quest to enact a unified legislation pertaining to data privacy and protection tabled the #digitalpersonaldataprotection bill, 2023 in the Loksabha. The proposed Bill extends to digital personal data processing: (i) within the territory of India, collected in digital and non-digital form (which is then digitized); and (ii) outside the territory of India, where the processing relates to offering of goods or services to individuals within India. The #DPDP Bill identifies consent by the individual and certain legitimate uses as the two grounds for data processing while providing certain exemptions for data processing. The Indian government recently passed the Digital Personal Data Protection Act (DPDP 2023) to help safeguard individual user data in digital spaces. I attended a session chaired by Rajeev Chandrasekhar, Minister of State for Electronics and Information Technology of India, and Sharad Sharma, Founder of iSpirit, a non-profit technology think tank. This session organized by Tejasvi Surya under the Sansad Dhvani initiative shed light on the implications of the DPDP law. Individuals will now have more control over how their data is collected. Companies are mandated to take explicit consent from users before processing their data, and ensure strict security to safeguard it against breaches. Additionally, parental consent will be required before processing children's data. Under no circumstances can a company track or monitor children, or direct ads at them. And the nuisance of spam calls, emails and text messages will finally stop. The government will impose penalties of up to Rs 250 crore on digital service providers who cause leak of personal contact details from their database. With the aim of ensuring the protection of digital rights while maintaining business continuity, major players in social media, big tech, and fintech sectors are looking to secure more time, contrasting the government's 12-month compliance window. Key challenges include verifiable parental consent for data collection from children and adapting to the new consent manager framework, both of which industry insiders believe will require at least 18 months for seamless integration. Kumar Deep, Country Director at ITI Council, states, "We are advocating for workable timelines of 9-24 months, depending on the architecture our companies need for DPDP Act compliance." Industry bodies like the US-India Business Council, ITI Council, FICCI, and IAMAI are gathering insights from companies and startups in India to present formal feedback shortly.
