The Colorado Attorney General's Office has recently unveiled an important development under the Colorado Privacy Act and its accompanying regulations. They've released an official list of approved universal opt-out mechanisms (UOOM). 🔍 Key Highlight: The list currently features the Global Privacy Control (GPC) as the recognized UOOM. This means that all entities operating under the Colorado Privacy Act need to integrate and acknowledge GPC by July 1, 2024. Colorado is one of a few states that have enacted #privacy legislation that requires or references a UOOM - or Universal Opt Out Mechanism. This still doesn't solve the underlying issue (that issue being that advertisers are convinced they are entitled to the attention of potential consumers), but it does offer folks a mechanism by which they can limit the sale of their #personaldata for targeted advertising. To say this is a good thing and desperately needed is a tremendous understatement. Not a perfect measure by any means, as Keir Lamont hints at below, but a big step in the right direction. #privacyisahumanright

Colorado is first to the line in providing specifics with regard to Universal Opt-Out Mechanisms. Under Colorado (and many other US state data protection laws) businesses that sell personal data or use personal data for targeted advertising are required to accept and adhere to universal opt-out signals that automatically opt users out of such selling or advertising activities. The Colorado AG has identified one such signal as valid under the Colorado Privacy Act: The Global Privacy Control developed by globalprivacycontrol.org. https://coag.gov/uoom/

🔔 Upcoming issue in ad tech to watch: Yesterday, the California Children's Data Privacy Act passed the assembly in California. ◼ This bill seeks to prohibit businesses from sharing for cross context behavioral advertising data of anyone under the age of 18 without consent. ◼ Would require the California Privacy Protection Agency to: 1. adopt regulations to establish technical specifications for an opt-out preference signal that allows the consumer, or the consumer's parent or guardian, to specify that the consumer is a child; and 2. adopt regulations regarding age verification.

Colorado posted a proposed list of three universal opt-out mechanisms--the #GPC, the OptOutCode, and the Opt-Out Machine--that companies will need to honor under the Colorado Privacy Act (the #CPA) starting July 1, 2024. [As a reminder, a user can send these signals to tell the company that they don't want their personal information sold or used for targeted advertising.] While six other states require (or will require once their law takes effect) compliance with an opt out signal, only Colorado has been nice enough to tell businesses which signals they must honor. This provides critical clarity and predictability for companies. Colorado's list could serve as an informal #safeharbor in other states. I suspect other states, at least until (or if) they issue their own guidance, will decline enforcement action when a company responds to all the signals on Colorado's list.

🗞️ Latest Industry News! 🗞️ A bipartisan group of lawmakers, led by Maria Cantwell and Cathy McMorris Rodgers, introduced the American Privacy Rights Act (APRA) to establish national standards for personal data protection online. If passed, APRA would give consumers more control over their data, including the right to access, delete, and opt out of targeted advertising.
