#newsalert COPYRIGHT AMENDMENT BILL: STATUS UPDATE In a recent TechCentral article entitled, ‘Mickey Mouse and South Africa’s battle over copyright’, journalist Sandra Lawrence claims that the Copyright Amendment Bill – ‘thrashed out by a select committee in March last year’ – ‘has now been sent to Ramaphosa for signing’. This is noting that it was ‘adopted’ by the National Council of Provinces in September 2023. In fact, several changes proposed by the NCOP Committee on Trade, Industry, Economic Development, Small Business, Tourism & Employment and Labour (referred to in the article as the select committee), reflected in the Copyright Amendment Bill’s most recently revised version and adopted by the NCOP in September 2023 must be endorsed by the National Assembly before the Bill is deemed to have been passed by both Houses and can then be signed into law. With that in mind, the revised Bill passed by the NCOP was sent to the National Assembly’s Trade, Industry & Competition Committee in September 2023 for concurrence. It has yet to be considered. A National Assembly committee briefing on changes made by the NCOP committee and passed by the House was arranged for 14 November 2023 but cancelled at less than 24 hours’ notice. At the time, the committee was expected to meet a week later to decide whether or not to endorse the NCOP’s changes. This arrangement also fell off the official parliamentary meetings list. However, according to a Parliamentary Monitoring Group (PMG) report on the committee’s 6 December 2023 planning meeting for this year’s first term, 6 February 2024 has been earmarked for the briefing. It remains to be seen if this meeting takes place. Old question: who has the copyright on publicly funded works. There is a lack of clarity on everything from economic survey to people’s biodiversity register. A second level question is how to obtain licenses even if copyright holders are identified. A third level question is should taxpayers pay again to get the licenses?

Following the introduction to New Zealand's Parliament of the Fair Digital News Bargaining Bill in August last year, a Select Committee hearing of submissions on the Bill is scheduled to take place later this month. In his latest article, AJ Park Consultant Ken Moon highlights a number of issues with the methodology of the Bill, and suggests that rather than requiring separate legislation, the proposed changes could simply be added to the Copyright Act, which is already currently under review. https://lnkd.in/gSKSHurx #copyrightlaw #digitalnews #legislation #legislativeupdate

As we are preparing for the next European elections, it is crucial to set the right policy priorities for the years to come in order to secure that the EU remains a vibrant environment for creativity. For this purpose, it is essential to reinforce the societal bargain that creates incentives for authors, but also creates room for downstream creativity and innovation. In our blogpost “Copyright as an Access Right: Concretizing Positive Obligations for Rightholders to Ensure the Exercise of User Rights”, Bernd Justin Jütte and I summarize the preliminary findings of a forthcoming study aiming to show why copyright law (finally) needs to put access to knowledge at the center of its preoccupation to achieve its purpose. It's World Book and Copyright Day! Today commemorates an important moment in protecting writers' rights. From the establishment of the Licensing of the Press Act in 1662, which initially focused on printers and publishers, to the landmark Statute of Anne in 1710, the first time copyright belonged to authors. With the current copyright case involving The Authors Guild and 17 well-known authors - like Johnathan Franzen, John Grisham, George R.R. Martin, and Jodi Picoult – suing OpenAI for copyright infringement, it's shedding light on the implications of AI and technology on writers.
