"Artificial intelligence, or AI, has held a spot in legal workflows for years (e.g., natural language searching). But when ChatGPT exploded on the scene as the fastest growing consumer app ever, it sparked fresh enthusiasm and interest about this new “Generative AI” or “GenAI”—along with skepticism and distrust from a historically conservative profession." Two things have been true about AI and law practice: ⚖️First, lawyers are using AI: for legal research, document review, back office, and everything in between. 🎤 Second, lawyers are reluctant to talk about this to judges. There’s a stigma, especially after two lawyers were fined for citing fake cases generated by ChatGPT. This second point may now change. A leading federal appeals court judge, just wrote an opinion arguing judges and lawyers should consider using AI when discerning the ordinary meaning of legal texts, including contracts and statutes. He argues that LLMs “can be expected to offer meaningful insight into the ordinary meaning of the term ‘landscaping’” – the term at issue in the case – “because the internet data on which they train contain so many uses of that term, from so many different sources.” His argument seems compelling and could change legal culture towards at least modest reliance on artificial intelligence for actually resolving legal disputes. OpenAI's ChatGPT reached 100 million users faster than TikTok or Instagram, underscoring the rapid adoption of generative AI tools across various industries, including the legal sector. These AI models assist in generating content ranging from web copy to legal documents, providing significant time savings. However, their accuracy and reliability remain concerning, particularly in legal contexts where precision is crucial. As AI continues to evolve, the legal profession must balance the benefits of efficiency with the imperative for accuracy, navigating these new tools with a critical eye toward their limitations and potential impacts. There are benefits and "dangers" but what's clear is it will continue to impact the legal profession. Lawyers need to understand how it works, how it can impact your practice and how you can use it for your benefit. This is not an IT issue this is a knowledge base issue!
It's official: Generative AI can help us understand legal language. This is the focus of a fascinating concurring opinion in a federal case published just yesterday! In it, Judge Newsom of the Eleventh Circuit explores how Generative AI tools like ChatGPT could offer valuable insights into the "ordinary meaning" of words and phrases used in legal disputes. What struck me most was his willingness to experiment with ChatGPT himself, even including the prompts and responses in his published opinion! Intrigued? Check out my latest blog post on this judicial opinion to delve into the potential benefits, risks, and what this could mean for the future of legal interpretation. https://lnkd.in/giUeQrwX

UK to speed up regulation of AI models City AM reports on potential new legislation that would likely limit the production of large language models such as ChatGPT and Google's Gemini. Sources told the paper the law would require developers of advanced AI models to share their algorithms with the Government and prove they have been safety tested. The Department for Science, Innovation and Technology (DSIT) is considering AI legislation, focusing on the technology behind AI products rather than the consumer-facing applications. The rumours come as the Competition and Markets Authority expresses concerns about the concentration of market power among technology giants producing large AI models and a number of MPs grow increasingly alarmed at the Government’s slow approach to AI regulation. In this post, ShahrYar Mahmoud Sharei, Marko Filijovic, and Abhijeet Shrivastava discuss amending the UN Charter with ChatGPT to showcase how Large Language Models (LLMs) manage complex legal questions and interpret significant legal texts like the UN Charter in the realm of international law. They argue that while LLMs like Chat GPT can facilitate international legal research, they must be used cautiously due to potential inaccuracies and "legal hallucinations." Click below to read more.
