The PAN Foundation appreciates the Centers for Medicare & Medicaid Services (CMS) finalized rules for expanding prescription medication coverage and access to dental care. These rules will help many patients across the country. Starting in 2025, health plans covering prescriptions beyond the state's benchmark plan must consider them essential health benefits, ensuring cost-sharing protections under the Affordable Care Act (ACA). Along with fellow patient advocates, PAN has pushed for this extension to also include large group and self-funded plans. CMS plans to introduce a rule aimed at further enhancing consumer protections within the ACA. Now, states will have the option to offer adult dental services as part of an essential health benefit package in their benchmark plans.  This change aligns state benchmark plans more closely with the private marketplace and gives states the opportunity to improve adult oral health and overall health outcomes. This could notably help reduce health disparities and advance health equity. While the above are positive outcomes of the rules, we are once again disappointed that CMS has not moved forward to enforce the recent court ruling regarding copay accumulator programs - programs that are preventing access to needed medications. We urge CMS to enforce the 2023 court ruling directing CMS to revert to the 2020 rule indicating that copay assistance should now count toward a patient’s deductible, coinsurance, copays, and annual cost-sharing limits, except in the situation when the brand-name medication has an equally effective generic. In the latest episode of Voices of Self-Funding by HCAA, I had the pleasure of hosting an insightful podcast with Fred Goldstein, Co-founder and Lead Host of PopHealth Week, to discuss emerging trends and strategies in the healthcare industry for 2024. Follow this story! "Post-mortems" of healthcare deals rarely get done and if they did more regularly, I'm sure these would be the findings. Ballad Health created a monopoly in their region back in 2018. They promised A LOT... It's 2024...and they haven't delivered on nearly any of it. They promised $300+ million is charitable contributions...less than half of that has been given. They promised a significant increase in quality...they failed to hit 80% of their metrics. And what's even better!? The CEOs annual compensation essentially doubled since the merger to $4.3mm/year. "Rahul Rao, a deputy director of the Bureau of Competition at the Federal Trade Commission, which consistently opposes COPAs, said removing hospital competition leads to predictable results — rising prices, decreasing quality, and monopolies that are very hard to break up." This stuff matters...follow this story! Just a Thought - Overcharging vs Undercharging for Health Care When health care providers "overcharge" for something, it is important to point out at the same time where they "undercharge" for other things. Hospitals provide free care for some, and below market prices for Medicare and Medicaid. Information in a vacuum only tells half the story, so information out of context means little. At the same time, not focusing on others who may overcharge is also a little deceptive. For example, the administration of health care and insurance far exceeds every other country. Where is the outrage here? Everyone says everyone else is at fault and the other guy is protecting the status quo.
