It borrows on headlines rather than facts and proposes regulation, while targeted at so-called “Wallstreet Landlords,” that will likely have unintended consequences for property owners and management companies of all sizes. The County should utilize data from property tax rolls to estimate the share of single-family detached homes owned by owner-occupants versus commercial entities like LLCs, banks, partnerships and look at single family detached property sales over the past 5 years to see trends in ownership. Concern: Many individuals and families own single-family homes and choose to rent them out once they upsize or downsize, or purchase homes as an investment opportunity. These homes help supplement small owner income, may be a sole source of income, or serve as their retirement plan. In other cases, these properties are intended to build generational wealth. Furthermore, many individuals, families, couples/domestic partners, structure their properties in LLCs, partnerships, and family trusts for tax and inheritance purposes. To assume that because title to property is in an LLC or partnership that it is owned by a so-called “Wallstreet Landlord” is not only inaccurate, but unfair.

As an article in the Orange County Register points out, the city of Orange identified housing "sites" in parking lots in existing shopping centers and malls to meet their sites inventory requirements. I have reviewed EVERY housing element for all Southern California jurisdictions and the city of Orange is not the only one. The article doesn't point out, however, that sometimes the shopping centers have multiple owners and often reciprocal parking and access agreements that make development of a single parcel impossible. Other examples of sites that could never be for housing, include Newport Beach (and many others) that identified sites with existing high-rise office buildings that would be so cost prohibitive to acquire for a housing project, it would be economically infeasible. And yet only 11 of Orange County's city are considered out of compliance. Only San Bernardino has a higher percentage of jurisdictions out of compliance: San Bernardino County: 44% Orange County: 31% Riverside County: 28% Los Angeles County: 27% San Diego County: 19%
