Five years ago, I helped file what was at the time the very first State Attorney General case filed against a tech company under the Children's Online Privacy Protection Act (COPPA) on behalf of the State of New Mexico. We sued a Lithuanian gaming app developer, Tiny Labs, as well as the Google Play Store, for marketing apps to children under 13 and collecting personal information about them in violation of federal and state law. Through that effort, we managed to create wholesale change in how mobile gaming apps are marketed to children nationwide. Today, 33 State Attorneys General filed a lawsuit against Meta Platforms and their subsidiary, Instagram, under COPPA in federal court in California. The suit alleges that Meta knows children under 13 are on Instagram and collects massive amounts of personal information about them anyway, flouting COPPA as well as commonly-understood precepts of child privacy and protection. Nine additional States will be filing their own lawsuits in state court, alleging a variety of consumer-related harms under their own state laws. 42 states in all, of every political stripe.
