A little-known fact 👉 MiCA’s market abuse requirements will apply directly across the EU by the end of 2024 and are not subject to any transitional period. Here are some key considerations: 📌 The Markets in Crypto-assets (MiCA) Regulation’s market abuse provisions are very broad and apply to persons professionally arranging or executing transactions (PPAETs) related to crypto-assets both inside and outside of the EU. 📌 This means market abuse provisions are not limited to crypto-asset service providers (CASPs) but also apply to issuers or offerors, individuals acting on a professional basis and possibly also decentralised finance (DeFi) platforms with identifiable intermediaries. 📌 PPAETs will be required to implement, document and regularly assess arrangements, systems and procedures to detect and report market abuse. Operators of trading platforms will be the most affected. 📌 Those caught need to be aware of market abuse unique to crypto, including the detection and prevention of market manipulation on social media and insider trading (especially by employees). 📌 CASPs preparing for MiCA authorisation need to look at market surveillance tools and consider cost and implementation effort ASAP. Those who demonstrate compliance early will be seen more favourably by their relevant EU regulator.
