On July 9th, the Department of Homeland Security (“DHS”), on behalf of the Forced Labor Enforcement Task Force (“FLETF”), released its 2024 Updates to the Strategy to Prevent the Importation of Goods Mined, Produced, or Manufactured with Forced Labor in the People’s Republic of China (the “Update”), as required by the Uyghur Forced Labor Prevention Act (“UFLPA”). Notably, the FLETF added three new high-priority sectors for enforcement: polyvinyl chloride (“PVC”), aluminum, and seafood. The Update noted that the FLETF will prioritize review of potential entities within these sectors for inclusion in the UFLPA Entity List – now including 68 entities – and the federal agencies will also target entities within these sectors for relevant enforcement. The Update also shed light on the process for identifying high-priority sectors for enforcement. Are you confident your “Made in the USA” claims meet the latest FTC standards? Last week, the Federal Trade Commission released an updated version of its Complying with the Made in USA Standard business guide. The heart of the guidance remains the same: if you expressly or implicitly state that a product is "Made in the USA" without any qualification, the product must be “all or virtually all” made in the USA. The FTC is cracking down and it’s crucial to stay compliant. Gonzalo Mon explains what's new and why you should review your claims now. The California AG’s office recently clarified the hidden fee law (SB 478), now in effect. A last-minute amendment (SB 1524) exempts certain businesses from including mandatory fees in displayed prices but requires clear disclosure by July 1, 2025. This change is expected to lead to increased litigation and enforcement.
