Everything in life is negotiable, other than killing oneself. If you have selected those prospects who you want to business with intelligently you, they are reasonable people, not the ones who will want you to die to save them. If not, and your clients include those who are unreasonable, you can unusually find a way to work with them or find out that will want a “win-win” where both of you can find an acceptable middle ground. If not, you must can’t be so reliant upon them (like if they represent 80% of your business), in the first place. Let’s assume you are not there and both of you can trim a bit off the edges, or: trade a deeper discount for a higher price, or more of their business, or something else so the “win-win” is deemed fair.

Once discussions have concluded on contractual scope and what's exceeded the original agreement, it may be a question of: 1. What was due to the consultant's incomplete or poor scope definition - which may need to be taken as an unpaid scope extension 2. What was clear from the scope definition but a sore point for the client - where carful negotiation of a CR may be needed. 3. An item which has the potential to lead to a new opportunity or a major factor in client relationship (and longer term work potential at the client) in which case a discounted scope extension may be appropriate.

Never cross wires at a personal or professional level. At the outset, before you begin, clarify, clarify and again clarify what the task entails. Never leave anything unsaid. As a professional, your first task is to eliminate all ambiguity. In the event you find yourself in a situation. Immediately call for a meeting. Accept your mistake. Believe me, it is indeed your mistake if you left things unclear. Be transparent about the situation and give 2 options to the client.

One thing to add on the top of all the valuable insights shared here is to ask yourself are you there for a long term or short term gain. When you are negotiating with the customer this particular project scope, are you by any chance negotiating the future contracts as well? This is the case especially if your customer is from the Middle East area and you are from far more transactional culture. Answer this question first, consult with senior leaders about the strategy for your business unit / region, they will share the insights with you gladly. Then you will know where to adjust and be flexible more and when to negotiate to win without killing the entire deal.

It is also important to distinguish between expectations and reality. There is a contract which might state a legal obligation but I have found that this is still open to interpretation on many different sides. Its always a good idea to review this at the beginning of the project to understand what everyone thinks it means is going to be delivered, and also what it means in spirit and not just in letter. Any adjustments to expectations or reality can be made if found then, and if found later, you have already established an open relationship and precedent for communication and how to deal with it. This is also an area where the Agile methodology comes in handy.
