SOFT GOODS 1-YEAR LIMITED WARRANTY

PRODUCTS COVERED BY THIS LIMITED WARRANTY:

This 1-year limited warranty extends to Soft Goods manufactured by Dagne Dover purchased directly from Dagne Dover or an authorized retailer. A list of authorized retailers can be requested by emailing the address at the end of this limited warranty. “Soft Goods” means any non-rolling bag or accessory manufactured by or on behalf of Dagne Dover. This limited warranty does not cover products, including Soft Goods, if used in a manner incompatible with the intended design, or if the care instructions provided on DagneDover.com are not followed.

LIMITED WARRANTY AND RESPONSIBILITIES:

Dagne Dover warrants the Soft Goods sold to the customer against the defects in material and workmanship set forth below (“Defects”) for a period of one year from the date of purchase. If applicable law requires a warranty period longer than set out in this section, the limited warranty will be extended for such a time period and to the extent required by law. The warranty period is not extended if we repair or replace the respective Soft Good. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

WHO THIS LIMITED WARRANTY EXTENDS TO:

This limited warranty extends to the original purchaser of any Soft Good or, in the case of a gift, the original recipient of the Soft Good. The “original purchaser,” for the purposes of this limited warranty, is the first purchaser of the Soft Good from Dagne Dover or an authorized retailer. The “original recipient”, for purposes of this limited warranty, is the first recipient of the Soft Good purchased as a gift from Dagne Dover or an authorized retailer. All Dagne Dover warranties, including any implied warranties, are valid only for the period of time the Soft Goods are owned by the original purchaser/recipient. A copy of the purchase receipt is required to determine warranty applicability.

Except as described above, Dagne Dover limited warranties are not transferable and not applicable to use of the Soft Goods for commercial purposes.

WHAT THIS LIMITED WARRANTY COVERS:

This limited warranty applies to the following defects that render the Soft Good non-functional:

  • Manufacturing defects;
  • Handles that are ripped or torn, and are no longer usable;
  • Zippers that can no longer be opened or closed; and/or,
  • Fabric tears that render the Soft Good non-functional.

This limited warranty does not cover the following:

  • “Cosmetic Damage” which is defined as pilling, catches in the fabric, stains, color changes, normal wear and tear, or other non-functional changes in the appearance of the Soft Good that occur during normal handling and use of Soft Goods by any party, and which do not impair the functionality of the Soft Good.
  • Damage caused by misuse, accidents, overloading, improper care and cleaning methods, exposure to extreme temperatures or weather otherwise inconsistent with the intended use of each Soft Good (e.g., rain in the event a Soft Good is not waterproof), negligence, or during transit (e.g., by an airline). In the case of damage during transit, the user is responsible for filing a claim with the transit company at the time of the damage.
  • Changes in fabric that are inherent in the normal use of the Soft Goods, such as the softening of leather or catches in neoprene.
  • Chipping of metal or painted elements in or on the Soft Goods.
  • Replacement of any non-defective pieces in the Soft Good or set of Soft Goods purchased (for example, if a Soft Good purchased contains multiple components or pieces, such as a key leash, and only one component is defective, only the defective component will be replaced).
  • Any Soft Goods (whether manufactured by Dagne Dover or not) sold by resellers who are not authorized retailers.
  • Soft Goods sold "mid-summer sale", “sample sale”, “warehouse sale”, or any other similar wording indicating that the Soft Goods are not of “first quality”, or have previously been purchased or used by another consumer.
  • Soft Goods or components that are lost or stolen.
  • Incidental and/or consequential damage, such as damage to or loss of contents of a Soft Good.
  • External causes, such as accidents, abuse, or other actions or events beyond our reasonable control including, without limitation, damage caused by pets.

In the event of a Defect, Dagne Dover’s sole and exclusive liability and the customer’s sole remedy under this limited warranty will be, at Dagne Dover’s option, to provide replacement Soft Goods, subject to the fulfillment of “Your Responsibilities” below. Replacement Soft Goods may be provided in a color different from the Soft Goods originally purchased and there is no assurance, representation, or warranty that any replacement Soft Goods will be identical to or will offer the same functionalities as the Soft Good returned to us. In all cases, comparability will be determined by us at our sole discretion, however, we will make reasonable efforts to replace any covered Soft Good with the Soft Good in our current inventory that is most similar to the returned Soft Good. For limited edition, discontinued or out-of-stock Soft Goods covered under the limited warranty, Dagne Dover guarantees only replacement of a Soft Good with equal or greater retail value and does not guarantee replacement of the same limited edition, discontinued or out-of-stock item.

YOUR RESPONSIBILITIES:

In the event of a Defect and in order to get the benefit of this limited warranty, you must return your Soft Good to Dagne Dover and provide proof of the original date of purchase. Evidence of a Defect and any claims must be sent to the email address set forth at the end of this limited warranty. Dagne Dover will replace (as applicable) and ship your new Soft Good to you after receiving your original Soft Good. You will not be responsible for any shipping costs associated with shipping replaced Soft Goods. If the Soft Good is shipped internationally, you will be responsible for applicable customs and duties. You are responsible for providing appropriate packing or shipping materials to return the Soft Good to our warehouse. Dagne Dover does not provide boxes or other packing or shipping materials. Any Soft Good shipped to Dagne Dover or our warehouse without appropriate packing or shipping that completely cover the Soft Good will not be accepted under this limited warranty.

Replaced Soft Goods are subject to the same limited warranty as the original Soft Goods for the remaining duration of the original limited warranty only.

LIMITATION OF LIABILITY:

THE REMEDIES DESCRIBED ABOVE ARE YOUR SOLE AND EXCLUSIVE REMEDIES AND OUR ENTIRE LIABILITY FOR ANY BREACH OF THIS LIMITED WARRANTY. WE EXPLICITLY DISCLAIM ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND AGAINST HIDDEN OR LATENT DEFECTS. IF WE CANNOT LAWFULLY DISCLAIM STATUTORY OR IMPLIED WARRANTIES, THEN TO THE EXTENT PERMITTED BY LAW, ALL SUCH WARRANTIES SHALL BE LIMITED TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY AND TO REPLACEMENT SERVICE. OUR LIABILITY SHALL UNDER NO CIRCUMSTANCES EXCEED THE ACTUAL AMOUNT PAID BY YOU FOR THE DEFECTIVE SOFT GOOD, NOR SHALL WE UNDER ANY CIRCUMSTANCES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES OR LOSSES, WHETHER DIRECT OR INDIRECT. DAGNE DOVER WILL NOT BE LIABLE TO YOU IN THE EVENT OF AN INJURY TO YOUR PET OR ANY OTHER ANIMAL IN CONNECTION WITH THE USE OF ANY SOFT GOOD.

SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. This limited warranty gives you specific rights. You may have additional rights under applicable law, and this limited warranty does not affect such rights.

GOVERNING LAW AND FORUM:

This limited warranty and any action related thereto will be governed by the laws of the State of New York without regard to its conflict of laws provisions. The exclusive jurisdiction for all disputes that you and Warrantor will be the state and federal courts located in the New York City in the State of New York, and you and Warrantor each waive any objection to jurisdiction and venue in such courts.

LUGGAGE LIMITED LIFETIME WARRANTY

PRODUCTS COVERED BY THIS LIMITED LIFETIME WARRANTY:

This limited lifetime warranty extends to rolling luggage manufactured by or on behalf of Dagne Dover (“Luggage”) and purchased directly from Dagne Dover or an authorized retailer. A list of authorized retailers can be requested by emailing the address at the end of this limited warranty. This limited warranty does not cover Luggage if used in a manner incompatible with the intended design, or if the care instructions provided on DagneDover.com are not followed.

LIMITED LIFETIME WARRANTY AND RESPONSIBILITIES:

Dagne Dover warrants the products sold to the customer against the defects in material and workmanship set forth below (“Defects”) for the reasonable lifetime of the Luggage. The reasonable lifetime of the Luggage means the period of 10 years from the original purchase date of the Luggage, provided that such purchase is made directly from Dagne Dover or an authorized retailer. If applicable law requires a warranty period longer than set out in this section, this limited warranty will be extended for such a time period and to the extent required by law. The warranty period is not extended if we repair or replace the Luggage. We may change the availability of this limited warranty at our discretion, but any changes will not be retroactive.

The products eligible for the Limited Lifetime Warranty are covered for the lifetime of the Luggage, which is the period of 10 years from the original purchase date of the Luggage, provided that such purchase is made directly from Dagne Dover or an authorized retailer. All references to “lifetime” in this warranty mean that 10-year period following the original purchase date of the Luggage. "Lifetime" does not refer to the lifetime of the purchaser or gift recipient.

In all cases, product comparability will be determined by us at our sole discretion, however, we will make reasonable efforts to replace any covered product with the product in our current inventory that is most similar to the returned product. For limited edition, discontinued or out-of-stock products covered under the limited warranty, Dagne Dover guarantees only replacement of a product with equal or greater retail value and does not guarantee replacement of the same limited edition, discontinued or out-of-stock item.
